Now that I have won in small claims court, I will address the owner’s comments on my review:
The flat roof listed that was a “gift” from EZ Roofing for $1,200, was actually covered by insurance and did not cost EZ Roofing a dime. I have at least 3 text messages saying it was covered by insurance, from the owner. That is the same guy saying he “gifted it”, “from the goodness of his heart”. They did not, in any way, provide me free roofing. And just to mention, my new roof has since leaked, and I’ve had to have someone repair it. I don’t know about the owner’s heart, but he is a piece of work for sure. He mentions a $200 credit for a ‘heat wave’ delaying the roof repair. It was actually a $350 credit, for a delay because of heat, but the workers had already been delayed twice and the day they did work was the same temperature as the day they didn’t come, much like many other days that summer. Regardless I didn’t complain about them not showing up, I had no problem with a 3-day delay, was not a big deal to me.
In regards to “going above and beyond”, not only did they not go above and beyond, they took 5 months to repair my fence (that I had mentioned when I signed my contract and MANY other times, was priority 1 because it protects my dogs). I signed my contract at the end of June, they finished my fence in December.
The referral fee that he said they “did not win the job or complete it” is why we went to court. I gave EZ Roofing my dad’s contact information for them to repair his roof. I would get a $500 (not a $650) credit towards my out-of-pocket expenses (my home insurance deductible of $1,000). They did not contact my dad in over a month and a half. Therefore, he was forced to find a different contractor. EZ Roofing dropped the ball and offered to honor the credit because it was their mistake. However, when it came time to finalize the payment on my account, they refused to honor the credit. They were in error and owed me the credit. THE JUDGE IN SMALL CLAIMS COURT AGREED.
As to my income and my title(s) (which he listed incorrectly) is irrelevant to this case. I don’t have to pay more if I make more. I paid what I agreed to pay, to the penny. The owner was very unprofessional on many occasions. And prone to hissy fits and hatefulness. The 1 star review had nothing to do with a looming court date, but had everything to do with how I rate the company. They have put a mark on my credit, a lien on my home and took me to small claims court. The financial issue was $500, to which EZ Roofing tacked on a late fee for more than $600, lawyer's fees of $500 and an 18% interest fee ($1,800 total). They even hired a lawyer for court. The judge threw out the lawyer’s fee, the $500 credit and the 18% interest and is making me pay the late fee. I do not understand that decision, but I will do as he has ordered. Per the judge’s decision since EZ Roofing did owe me the $500, that means I wasn’t late paying anything, and I didn’t owe them any additional money.
If anything needs to be clarified, please look the case up on court connect. (There are currently 62 cases on court connect involving EZ Roofing.) All conversations, documents, everything is listed in the case. There are many other issues, that don’t seem prudent to address in this review. I hope this is helpful.
