Buyer beware! We signed an agreement with David Fertig in February 2023 for him to build a cabin. In the contract, it was supposed to be done by October 2023. It is now almost June 2025, and it isn't anywhere near completion. It is one excuse after another. The cost is significantly higher than he originally quoted us and a lot of it is because he forgot to include it in the quote. I would highly discourage anybody who wants work to get done and on time to go elsewhere. I am disappointed beyond imagine by David Fertig and Bear Mountain Contracting.
I talked with David Fertig on a conference call with K.C. of Capstone Industrial in December 2020. KC recommended David. I further met with David in his office and on my property. As a result of these meetings and KCs recommendation I deposited $70,000 with David in December.
David advised his design process would take two weeks even with the plans I provided him. One week after this timeline which David dictated, approximately the third week of January, I requesting a date to meet to review completed plans. David told me he needed an additional month to complete design phase. I accepted the delay and waited the month. Not hearing anything from David the last week of February I contacted David requesting a design completion meeting. I was not told at this time the design had not been completed let alone started.
Today, March 1, 2021, I met with David, again at my request, and was greeted with I have bad news. Because of other work David would not be able to work my project this year. I asked David what I owed him for the design work for which he requested the additional month and the reason I was in his office. He stated $225. I asked why so low. His response was that he had not done the design.
He returned $70,000 deposit in the form of a bank check that was 'previously drafted' and sitting on his desk. I took receipt of my plans and the check and departed without a word.
It is one thing to have signed work proceed your project in scheduling. I accept this. It is another thing to be told design work world take two weeks, ask for four more weeks after the client requests a design meeting and not deliver the design. Was my $70,000 held until David had sufficient signed worked. Sure seems like it especially since he requested an additional month for design work he never completed.
